“Products” refers to the products or items offered for sale on the Website.
“Order” means a request by You to purchase Products from Us.
“Promotions” refers to contests or other promotions offered through the Website.
“Website” refers to the Website.
“Terms and Conditions” (also referred as "Terms") mean these Terms and Conditions (including the Privacy Policy) that form the entire agreement between You and the Company regarding the use of the Website, including the use of Our e-shop.
“Third-party Social Media Website” means any websites or content (including data, information, products or websites) provided by a third-party that may be displayed, included or made available by the Website.

“You” means the individual accessing or using the Website, or the company, or other legal entity on behalf of which such individual is accessing or using the Website, as applicable.

These are the Terms and Conditions governing the use of this Website and the agreement that operates between You and the Company (including transacting with Us, by purchasing Products through our e-shop). These Terms and Conditions set out the rights and obligations of all users regarding the use of the Website. Your access to and use of the Website is conditioned on Your acceptance of and compliance with these Terms and Conditions.

These Terms and Conditions apply to all visitors, users and others who access or use the Website. By accessing or using the Website You agree to be bound by these Terms and Conditions. If You disagree with, or do not understand, any part of these Terms and Conditions then You may not access the Website and/or refrain from using it.

If you are under 18 years of age, you may use the non-transactional parts of the Website but you may not purchase Products from the Website. By ordering Products you represent that you are 18 years of age or older and legally capable of entering into binding contracts.

You declare and guarantee that You will use the Website in accordance with the Terms and Conditions, the applicable rules and provisions of national, European Community and international law and ethics. You shall be responsible for the restoration of any damage caused to the Company or any third party, by improper and/or misuse of the services or pages or any part of this Website as well as publishing and transmitting any information, text, software or file.

Your access to and use of the Website is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Website and tells You about Your privacy rights and how the law protects You. User Accounts

When You create an account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Website. You are responsible for safeguarding the password that You use to access the Website and for any activities or actions under Your password. You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

Placing Orders for Products

By placing an Order for Products through the Website, You warrant that You are legally capable of entering into binding contracts. Orders through the Website can only be completed in English.

Your Information

If You wish to place an Order for Products available on the Website, You will be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information. You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete. By submitting such information, You grant us the right to provide the information to payment processing third parties (such as JCC Payment Systems) for purposes of facilitating the completion of Your Order and to courier companies (such as ACS Cyprus) for delivery of Your Order.

Order Procedure

The process for placing and completing an online Order through the Website is as follows:

The ‘Shop Now’ section of the Website lists the Products that are available for online purchases and displays the Product characteristics and prices including VAT.
Select the Product from the ‘Shop Now’ Product list and ‘Add to cart’.
Go to ‘My Cart’ where you can still change Product quantities or remove Products and ‘Update cart’ and proceed to ‘Checkout’.
You will be prompted to ‘Log in’ or to ‘Proceed as Guest’ and create an account at the end.
Confirm shipping and billing information and choose shipping method.
Review Order and read and agree to the Terms & Conditions.
You will be redirected to JCC Payments Gateway to execute credit/debit card payment
Upon completion of the Order You will receive an Order confirmation by email (to the email address provided by You).

Orders can be completed electronically through the ‘Show Now’ feature of the Website only for deliveries within Cyprus. For overseas deliveries You can enquire by submitting a request via ‘My List’ form and Our team will get in touch. Similarly, other enquiries, such as wholesale and custom requests, can be submitted via ‘My List’ or ‘Contact Us’ forms.

Return Policy

You have the right to return any Product in mint condition, sealed, unused and with the proof of purchase within 30 calendar days from the day of receipt, and We will exchange it or issue a credit voucher (as appropriate, and as per your request) after inspection. You can return the Products by personal delivery to one of Our locations (please see “Contact Us” section for more information), or via courier to Dynamec at 47 Kyriacou Matsi, 1085, Nicosia, Cyprus, Tel. 22318881. In both cases, please consider to mark the returning package as “e-shop return” and include the proof of purchase. Any shipping costs related to the return of Products will be covered by You, unless the Product is damaged or was delivered to You in error. Claims for damaged or delivered-in-error products will be accepted within 2 business days after receipt. Please inspect Products immediately.

Right of Withdrawal

You have the right to withdraw from the contract of sale within 14 calendar days from the day You receive the Products without mentioning any reasons (certain exceptions apply) provided that You return the Products in mint condition, sealed and unused. To exercise the right of withdrawal, you may send an email or by post attaching thereto the completed withdrawal form (see below), or using such equivalent wording to let Us know that You wish to exercise Your right of withdrawal. If you do elect to withdraw from the contract of sale, we shall return all money received from You in relation to such contract including delivery costs (excluding any additional costs incurred because of Your election to use a delivery manner other than the cheapest delivery manner offered by Us). Any shipping cost related to the return of the Products will be covered by You. Please refer to model withdrawal form below:

Order Cancellation

We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to: Products availability, errors in the description or prices of Products, or errors in Your Order. In case of Order cancellation any payment will be refunded in full. We also reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.

Right of Amendment

We are constantly updating Our offerings of Products on the Website. Whilst the Company makes every effort to ensure that information on the Website is accurate, we cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information on the Website at any time without prior notice.

Prices Policy

All prices listed on the Website are inclusive of VAT, are valid for online purchases only and as at the time of submission of your Order. The Company reserves the right to revise its prices at any time prior to accepting an Order. The prices quoted may be revised by the Company subsequent to accepting an Order in the event of a change in the VAT rate.

Payments

Payment can be made by credit or debit card such as VISA, MasterCard, Maestro through the JCC Payments Gateway. Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.

Promotions

Any Promotions made available through the Website may be governed by rules that are separate from these Terms. If You participate in any Promotions, please review the applicable rules as well as our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

Intellectual Property (IP)

The Website and its content, features and functionality (including design, badges, logos, graphics, texts, documents, photographs, databases) are and will remain the exclusive property of the Company, its licensors and other third parties, and are protected by the relevant provisions of applicable law (including Cyprus, European Community and / or third country). The Products may constitute intellectual property of third parties, and may be protected by copyright, trademark and other laws in Cyprus or other jurisdictions.

Reproduction of Content

No part of this Website may be reproduced, republished, placed, distributed or transmitted, in any form or by any means, without the prior written permission and /or consent of the Company. On the other hand, individual copying and printing of a single copy, part of the content for personal and not public or commercial use is permitted, provided that the intellectual property rights of the Company are not affected in any manner.

Your Feedback to Us

You assign all rights, title and interest in any Feedback You provide the Company. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Website will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Website and / or delete the Account.

Limitation of Liability

Our liability to you in connection with any Product purchased through the Website is strictly limited to the purchase price of that Product. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Website, third-party software and/or third-party hardware used with the Website, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Any proceedings in connection with these Terms shall be brought before the Courts of the Republic of Cyprus.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law or deleted, and the remaining provisions will continue in full force and effect.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. Any changes will be posted on Our Website and become effective at the time of posting. By continuing to access or use Our Website after those revisions become effective, You agree to be bound by the revised terms.
